Below you can read the standard terms and conditions that apply in the event of returns and similar matters.

Terms and Conditions / Service Terms

The following terms apply to all purchases of goods in Molly’s Heart’s online shop (www.mollysheart.com). All information, including these terms, in the webshop and in connection with placing an order is provided in Danish, and agreements are entered into in Danish.

Danish law governs the terms of purchases made in Molly’s Heart’s webshop, and any disputes shall be settled by the Danish courts.

These terms and conditions must be accepted by the customer when placing an order and will always be available at www.mollysheart.dk. We encourage our customers to read the terms and conditions carefully.

The terms will be updated on an ongoing basis. Last updated: February 2023.

Ordering Goods

A final agreement between you and Molly’s Heart ApS is considered entered into once Molly’s Heart ApS has confirmed the order.

If Molly’s Heart ApS is unable to fulfil your order, you will be contacted as soon as possible by email.

You are responsible for, and bear the risk of, ensuring that the customer information entered is correct, as Molly’s Heart ApS does not subsequently validate or check this information.

We reserve the right to sold-out items, printing errors and any changes in duties or taxes.

Prices and Payment

The applicable price is the price stated in our webshop next to the relevant item on the day the order is placed. All prices stated include VAT, currently 25%. We reserve the right to change prices with immediate effect.

Shipping costs are not included in the price.

For every order placed at www.mollysheart.dk, an amount will be added to cover shipping costs, unless otherwise stated, for example if we offer free shipping as part of a campaign. The shipping costs will appear in the order overview, which the buyer approves before finalising the order, as well as in the order confirmation sent by email after the purchase has been accepted.

Molly’s Heart ApS accepts payment by MobilePay, VISA-Dankort, MasterCard, Google Pay and Apple Pay.

The amount will only be charged to your account when we dispatch the order.

Molly’s Heart ApS encrypts all your card information using the SSL, Secure Socket Layer, protocol. This means that unauthorised persons cannot read your card number or other information during the transaction with QuickPay.

Purchase Confirmation

Once you have entered your payment information and accepted the purchase, you will receive an order confirmation by email.

Delivery

Molly’s Heart ApS has entered into agreements with suitable distribution companies for delivery of orders to the delivery address provided. It is an advantage, and will ensure faster delivery, if parcels can also be received at the delivery address during daytime hours.

We normally dispatch the order within 2–5 business days after your order has been confirmed.

As Molly’s Heart ApS cannot guarantee local delivery conditions, we cannot state with certainty when the order will be delivered to the delivery address provided.

We currently deliver in Denmark, excluding Greenland and the Faroe Islands.

Right of Withdrawal

In accordance with the Danish Consumer Contracts Act, you have a 14-day right of withdrawal on items purchased at www.mollysheart.dk, calculated from the day the goods are received. If you regret a purchase, you must return the goods in substantially the same condition and quantity as when you received them. The packaging constitutes an essential part of the product as a whole. Missing or damaged original packaging may mean that the product is not considered returned in substantially the same condition and quantity.

The right of withdrawal lapses if the product has been used, as this may result in a reduction of the product’s value.

If you exercise your right of withdrawal, you as the customer are responsible for the cost of returning the item to Molly’s Heart ApS. Once the returned item has been received and approved, the purchase price, excluding shipping, will be transferred to your account or credit card as soon as possible and no later than 30 days after receipt. To ensure the fastest possible processing, please enclose the delivery note you received with the shipment or the confirmation you received when placing the order. If you do not wish the amount to be refunded to your credit card, please provide the bank account to which you would like the amount transferred.

You may also withdraw from the purchase by refusing to accept the item upon delivery.

Regardless of how you exercise your right of withdrawal, you are responsible for covering the shipping costs to our address.

Right of Complaint

In accordance with the Danish Sale of Goods Act, you have a 24-month right of complaint on items purchased at www.mollysheart.dk. This means that, depending on the specific situation, you may be entitled to have the item repaired, exchanged, refunded or receive a price reduction. This naturally requires that the complaint is justified and that the defect or damage has not occurred as a result of incorrect use or other damaging behaviour.

You must make your complaint within a reasonable time after discovering the defect or damage. If you make a complaint within two months of discovering the defect or damage, the complaint will always be considered timely.

You must always contact us at kundeservice@mollysheart.dk if you wish to make a complaint regarding products purchased in our webshop. Please describe the nature of your complaint and send photo documentation together with a copy of your invoice. We will then agree on the practical details regarding your complaint.

Returned items, whether returned under the right of withdrawal or the right of complaint, must be sent to the following address:

The delivery note or receipt that accompanied the item when you received it, or the order confirmation you received when placing the order, must be enclosed with the return.

Processing of Personal Data – GDPR

Molly’s Heart ApS is subject to the General Data Protection Regulation, which regulates all processing of personal data in the EU. Molly’s Heart ApS is considered the data controller for the information registered about customers and visitors at www.mollysheart.dk. When making a purchase in our webshop, you accept our policy on the protection of your personal data.

Molly’s Heart ApS collects information about you in various ways when you use our webshop. The guidelines below describe in more detail what type of information we collect, how we process this data, and whom you can contact if you have questions or comments regarding our guidelines.

How Do We Protect Your Personal Data?

It is important to Molly’s Heart ApS that your personal information is stored securely and confidentially. Access to all registered customer data in our webshop is limited to trusted employees of Molly’s Heart ApS, and our security measures are checked regularly to determine whether information about our users is handled responsibly and with continuous regard for the customer’s rights.

Unfortunately, however, it is not possible to guarantee 100% security when data is transferred via the internet. When data is sent and stored electronically, there is always a risk that unauthorised persons may gain access to protected data before it reaches our server. Therefore, although Molly’s Heart ApS seeks to protect your personal information in the best possible way, we cannot ensure or guarantee security.

What Information Do We Collect?

Molly’s Heart ApS obtains information about our customers in two ways: through cookies, see our cookie policy here (link), and through registration in our webshop.

The purpose of collecting personal information about you as a customer is to be able to send you newsletters, if you wish, invite you to participate in competitions, events and similar activities, and to make it easier for you to use our webshop for repeat orders. The information we store is primarily information such as email, name and address.

When making a purchase in our webshop, Molly’s Heart ApS requests your name, address, telephone number and email address, which are necessary to process the order and are used exclusively for processing the order. The information is transmitted and stored electronically in unencrypted form for 5 years.

You may optionally have your email address added to a mailing list at Molly’s Heart ApS, so that you can regularly receive news and other information from Molly’s Heart ApS. You can subscribe to and unsubscribe from this service at any time and free of charge.

Who Do We Share Personal Data With?

When you register in our webshop or otherwise provide information, Molly’s Heart ApS will under no circumstances disclose or sell information that can be linked to identifiable individuals to third parties without your explicit permission. Log files and other standard information are likewise not disclosed to third parties.

Changes to the Guidelines

The rapid development of the internet may make changes to our processing of personal information necessary. Molly’s Heart ApS therefore reserves the right to update and amend the guidelines in this document on an ongoing basis. When we do so, we will also update the date, last updated, at the top of the document. In the event of significant changes, Molly’s Heart ApS will notify you by placing a notice in a prominent location in our webshop.

Your Consent and Changes/Deletion

When you visit our webshop, you accept the above guidelines.

If your personal information changes, for example your email address, or if you no longer wish to use the services you have signed up for in our webshop, it is possible to update or delete your personal information either by logging into your account or by sending an email to our customer service at kundeservice@mollysheart.dk.
